Article 1 (Definitions)

In these Terms, the terms below shall have the meanings set forth in the respective items.

1. "Site" means the "NEW MONSTER GENERAL ELECTION" special website operated by us.
2. "Service" means the voting feature for monster characters and any and all other services we provide on the Site.
3. "User" means any person who uses the Service.
4. "Content" means any text, images, videos, character designs, and any and all other information provided through the Service.

Article 2 (Scope of Application; Consent)

1. These Terms shall apply to any and all relationships between Users and us in connection with the use of the Service.
2. Users shall be deemed to have agreed to these Terms at the time they cast a vote or otherwise indicate their intent on the Site.
3. If a User is a minor, the User shall obtain the prior consent of a parent or other legal representative before using the Service.

Article 3 (Posting and Amendment of These Terms)

1. We will post these Terms in a readily accessible location on the Site.
2. We may amend these Terms without prior notice to Users where we consider it necessary to do so. The amended Terms shall take effect from the time they are posted on the Site.

Article 4 (Description of the Service)

1. The Service allows a User to select a monster character of their choice from among those posted on the Site and cast a vote for that character (such an act, a "Vote").
2. Each User may cast one Vote per day, for the same or a different monster character. The limit on the number of Votes is determined using technical means such as Cookies stored on the User's device, and resets at 12:00 a.m. Japan Standard Time.
3. The handling of information collected in connection with Voting shall be governed by our separately established Privacy Policy for the Service (https://newmonsterelection.com/en/privacy/).
4. The Service is available free of charge; however, Users shall bear any communication charges, costs of their communication environment, and other costs necessary to use the Service.

Article 5 (Prohibited Acts)

Users shall not engage in any of the following acts in using the Service:

1. Acts that violate any law, regulation, or public order and morals;
2. Acts of voting through the misuse of technical means or any other wrongful method for the purpose of circumventing the once-per-day voting limit;
3. Acts that infringe our or a third party's intellectual property rights, rights of publicity or portrait rights, privacy, or other rights;
4. Acts of reproducing, modifying, reverse engineering, decompiling, or disassembling any program relating to the Service;
5. Acts of removing or altering any copyright notice or other indication of rights appearing on Content relating to the Service;
6. Acts of placing an excessive load on our servers or network, engaging in unauthorized access, or transmitting a harmful program;
7. Acts of impersonating us or a third party; or
8. Any other act that we consider inappropriate.

Article 6 (Response to Fraudulent Voting)

1. If we discover a fraudulent Vote made by a method described in item 2 of the preceding Article or otherwise, we may invalidate that Vote without prior notice to the User of the reason.
2. Where we consider it necessary to maintain the fairness of the Service, we may change the method of tabulating voting results, suspend Voting, or take any other necessary measure, in each case without prior notice.

Article 7 (Intellectual Property Rights)

1. The copyrights, trademark rights, and other intellectual property rights in the designs, names, and other Content of the monster characters provided on the Site and through the Service belong to us (excluding the logo of Shirogumi Inc., the rights to which belong to Shirogumi Inc.).
2. Users shall not reproduce, republish, modify, distribute, or otherwise use Content beyond the scope of the purpose of using the Service.
3. Sharing part of the Content through an SNS sharing feature or similar function relating to the Service shall be permitted only within the scope of the usage methods we separately establish.

Article 8 (Handling of Personal Information)

The handling of information we collect in connection with the Service shall be governed by the terms of our separately established Privacy Policy for the Service (https://newmonsterelection.com/en/privacy/), and Users shall use the Service only after agreeing to the contents of that Policy.

Article 9 (Disclaimer Regarding Third-Party Services)

The Service may be linked to services provided by third parties other than us, such as an SNS sharing feature. We assume no responsibility whatsoever for any damage arising from a User's use of such third-party services. Users should also review the terms of use and privacy policy of any such third-party service before using it.

Article 10 (Disclaimer of Warranties; Limitation of Liability)

1. We make no warranty, whether express or implied, that the Service will be fit for a User's particular purpose, will have the functionality, accuracy, or completeness that a User expects, or will be free of defects.
2. We may suspend or interrupt the provision of all or part of the Service without prior notice to Users due to system maintenance, inspection, failure, or other unavoidable circumstances.
3. Except in cases of our willful misconduct or gross negligence, we assume no responsibility whatsoever for any damage incurred by a User in connection with the suspension, interruption, termination, unavailability, or modification of the Service, or the deletion or loss of data posted or transmitted by a User, or otherwise in connection with the Service.

Article 11 (Suspension and Termination of the Service)

We may modify the content of the Service or terminate the provision of the Service at our discretion. We assume no responsibility whatsoever for any damage incurred by a User as a result.

Article 12 (Prohibition on Assignment of Rights and Obligations)

A User may not assign, or provide as collateral, all or part of the rights or obligations arising under these Terms to any third party.

Article 13 (Severability)

Even if any provision of these Terms is held to be invalid or unenforceable under applicable law, the remaining provisions of these Terms shall remain in full force and effect.

Article 14 (Governing Law and Jurisdiction)

These Terms shall be governed by the laws of Japan. Any dispute arising between us and a User in connection with the Service shall be subject to the exclusive jurisdiction of the Tokyo District Court as the court of first instance.
